Terms and Conditions of Use and Sale (T&C)

1. Acceptance of Terms

By using VoxPop, you unreservedly accept these Terms and Conditions. If you do not agree with all or part of these terms, you must not use the application.

2. Description of Services

VoxPop provides a survey and statistical analysis platform:

• Free Plan: Limited access to basic features.
• Smart Subscription: Advanced features, social sharing, AI analysis (using your own key).
• Pro Subscription: Commercial use, unlimited AI (included), data export.
• Advertiser Offer: Sponsored campaigns and precise targeting.

3. Pricing and Payment

• Prices are indicated in the application inclusive of all taxes.
• Payments are handled via the Apple App Store and Google Play Store platforms.
• VoxPop uses the RevenueCat service for the technical management of subscriptions.
• Subscriptions are billed in advance on the date of subscription.

4. Renewal and Termination

• Automatic Renewal: Unless cancelled at least 24 hours before the end of the current period, the subscription is tacitly renewed.
• Termination: The user can cancel their subscription at any time directly through their Apple or Google account settings. No refunds are made for the current period already started.

5. Refunds and Compensation

• Right of withdrawal: In accordance with applicable regulations, the user has a 14-day period from subscription to exercise their right of withdrawal, unless the service has been fully performed before the end of this period.
• Refund: In the event of withdrawal within the period, the refund is made within a maximum of 14 days following the withdrawal notification.
• Compensation: In the event of prolonged service unavailability (more than 72 consecutive hours) attributable to VoxPop, the user may be entitled to compensation equivalent to 7 additional subscription days offered.
• Conditions: No partial or pro-rata refund is granted for started subscription periods, unless otherwise required by law.

6. Intellectual Property

The application, its source code, design, logo, and content are the exclusive property of VoxPop Inc. Any reproduction is strictly prohibited without prior authorization.

7. Liability

• VoxPop strives to keep the application available 24/7 but cannot guarantee the absence of technical interruptions.
• VoxPop is not responsible for the content of surveys created by users, although we reserve the right to remove any illegal or inappropriate content.

8. Sanction Scale

In the event of non-compliance with these Terms and Conditions or the community charter, VoxPop applies a progressive sanction scale:

• Level 1 — Warning (Information)

  Simple notification. No account restrictions. The user is invited to acknowledge the reason and adjust their behavior.

• Level 2 — Temporary Suspension (24h)

  Temporary 24-hour ban. The user cannot vote, create surveys, or comment during this period.

• Level 3 — Permanent Ban

  Permanent removal of account access. The user can no longer use the application.

Grounds for Sanction

Sanctions may be applied for the following reasons, this list not being exhaustive:

• Non-compliance with the community charter
• Hateful or discriminatory speech (race, gender, sexual orientation, religion, etc.)
• Harassment of other members
• Pornographic or sexually explicit content
• Intentional disinformation
• Spam or unsolicited promotion
• Identity theft
• Circumvention of moderation rules (multiple account creation, etc.)
• Fraudulent behavior
• Attacks on secularism or aggressive proselytism
• Non-compliance with the terms and conditions of sale

Right of Appeal

Any sanctioned user may contest the decision by writing to support@voxpopapp.app. Each request is reviewed within 48 to 72 business hours.

9. Applicable Law

These T&C are subject to French law. In the event of a dispute, the competent courts will be those of the jurisdiction of the company's registered office.
